Terms of Service

1. Acceptance

Tennis For Life ("TFL") is a service of HonestTech Services LLC, a Delaware limited liability company with a registered address at 8 The Green, Suite B, Dover, DE 19901, United States ("HonestTech", "we", "us").

By creating an account or using the TFL website, mobile app, or related services (the "Service"), you agree to these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old to create an account. A parent or legal guardian may register a player profile for a minor ("Junior") and is solely responsible for that Junior's use of the Service. Juniors do not have their own accounts or logins; everything relating to a Junior is managed through the responsible adult's account. We do not knowingly collect personal information from children under 13 without verifiable parental consent (see our Privacy Policy).

You must be a resident of the United States and have legal capacity to enter into a binding contract.

3. Accounts

  • Registration requires a working email address and US mobile phone number; both are verified with a one-time PIN before your account is active.
  • You agree to provide accurate, current information and keep it updated.
  • You are responsible for all activity under your account and for safeguarding your credentials.
  • You may not share, sell, or transfer your account.
  • One person, one account. Pro accounts may be operated by an authorized representative of the business.
  • We may suspend or terminate accounts that violate these Terms, that we reasonably believe are fraudulent, or that pose risk to other users.

4. Player profiles & teams

Players added to the platform are linked to a user account. Only a controlling user account may edit or remove a player profile. If you add a player who is not yourself, you represent that you have the legal right to do so (e.g., parent/guardian relationship). Profile claims and ownership disputes are governed by our internal Profile Claims process; our decisions are final.

Doubles teams made up of two independently managed players are created only after both players (or their managing accounts) confirm the partnership. Either member may leave a team at any time, which dissolves the team.

5. Memberships, billing & payments

5.1 Memberships & subscriptions

Certain features require a paid membership subscription. Membership plans are billed per player seat; the pricing, features, and billing interval for each plan are shown at purchase.

5.2 Payment processing

All payments on the Service are processed by our payment processor, Stripe. Card details are entered directly with Stripe; we store only a payment-method reference and card metadata (brand, last four digits, expiration) — never your full card number. By adding a payment method you authorize us, through Stripe, to charge it for the purchases you make and the recurring charges described in this Section 5. Payments owed to coaches, instructors, and clubs ("Pros") are paid out to the Pro through Stripe Connect; Stripe handles the Pro's identity verification and applicable tax reporting.

5.3 Auto-renewal

Subscriptions automatically renew at the end of each billing period at the then-current price, until you cancel. You authorize us (through Stripe) to charge your payment method on each renewal. You will receive a renewal reminder where required by law.

5.4 Cancellation

You may cancel a subscription at any time from the Manage subscriptions page in your account. Cancellation takes effect at the end of the current billing period. Continued access until the end of the paid period is provided as a courtesy and may be revoked for Terms violations.

5.5 Refunds

Except where required by law or expressly stated in this Section 5, fees are non-refundable and we do not pro-rate partial periods. For one-time charges (such as tournament entry fees), you may submit a refund request from your billing history within 3 months of the charge; requests are reviewed by our team, and approved refunds are issued to the original payment method.

5.6 Pro Platform fee & seat plans

Pro accounts pay a recurring monthly Pro Platform fee in addition to per-player seat plans at the Pro tier. Current pricing and minimum seat requirements are shown during the upgrade flow. Pro features (such as hosting tournaments, lesson listings, and clubs) require an active, paid Pro Platform subscription.

5.7 Pro lesson listings

If you are a Pro and purchase a lesson listing, you authorize a recurring monthly listing charge. If a charge fails, your listing is hidden from search until payment is updated. We may remove listings that violate Section 8 or that contain false credentials.

5.8 Lesson bookings — TFL-managed and direct listings

Lesson listings operate in one of two modes, chosen by the Pro:

  • TFL-managed.The lesson price is charged to the player's payment method through the Service when the booking is confirmed, and paid out to the Pro via Stripe Connect. If the Pro cancels a booking, the player receives a full refund. If the player cancels, the listing's stated cancellation-notice window applies: cancellations made with the required notice are refunded; late cancellations may not be.
  • Direct. The listing is an advertisement and inquiry channel only. Scheduling and payment are arranged directly between the player and the Pro, off the platform; we are not a party to that transaction and process no payment for it.

5.9 Lesson classes

Enrollment in a recurring lesson class is billed as a monthly per-student subscription, which renews per Section 5.3 until you cancel or the Pro ends the class.

5.10 Tournament entry fees

Some tournaments charge an entry fee, shown before you register, and charged to your payment method at registration. For doubles events, a single team entry fee is charged to the payment method of the account that registers the team — not the partner's. Each tournament states its refund deadline: withdrawals before the deadline are refunded, withdrawals after it are not. If the organizer cancels a tournament, all paid entries are refunded in full. If the organizer reschedules a tournament, registrants receive a fresh window during which they may withdraw for a full refund.

5.11 Tournament waitlists

Joining a waitlist is free. By joining a waitlist you authorize us to charge the entry fee to your payment method on file automatically if a spot opens and you are promoted before the registration deadline. You will be notified when this happens, and you may leave the waitlist at any time before promotion to avoid the charge.

5.12 Private club memberships

Some Pros operate private clubs on the Service with their own club membership fee. Club fees are set by and paid to the operating Pro (via Stripe Connect); any TFL membership required to participate is a separate charge paid to us. The club's Pro — not HonestTech — is responsible for the club's own rules, fees, and offerings.

5.13 California residents

You have the right to cancel under the California Automatic Renewal Law. Contact: [email protected].

6. Referral & reward programs

We may offer optional promotional programs, such as refer-a-friend subscription credit and free merchandise or trophy fulfillment for eligible members. When you refer a friend, you must have their permission to share their contact information with us; we use it only to send the invitation. Reward programs are subject to availability and eligibility rules shown in the product, may require a shipping address for physical items, and may be changed or ended at any time.

7. User content

"User Content" includes anything you post, upload, message, or publish on the Service — community posts, replies, reviews, profile content, messages, photos, etc.

7.1 Ownership and license

You retain ownership of your User Content. You grant us a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to host, store, reproduce, modify (for formatting), create derivative works of, publicly display, and distribute your User Content for the purpose of operating, promoting, and improving the Service. This license survives termination for content you posted publicly.

7.2 Your representations

You represent that (a) you own or have all necessary rights to your User Content, (b) it does not violate any third-party rights, and (c) it complies with these Terms and applicable law.

7.3 Reviews

Reviews may only be left for a lesson you actually booked and completed through the Service, and must reflect your genuine, first-hand experience. You may not post fake, incentivized, or coerced reviews (FTC Endorsement Guides apply). Pros may post a public response to a review. We may remove reviews that violate this section or our Community Guidelines.

8. Prohibited conduct

You may not, and may not allow others to:

  • Harass, threaten, or intimidate other users
  • Post content that is unlawful, defamatory, obscene, sexually explicit, hateful, or that incites violence
  • Impersonate any person or misrepresent your identity, credentials, or affiliation
  • Solicit personal information from minors
  • Use the Service for commercial messaging outside of advertised features
  • Reverse-engineer, scrape, or use automated tools against the Service
  • Interfere with security features, rate limits, or moderation systems
  • Upload viruses, malware, or harmful code
  • Violate any law or third-party right

We may, in our sole discretion, remove content, restrict accounts, or take other action without prior notice. See our Community Guidelines for additional rules.

9. Moderation, reports & spam marks

We provide tools to report users, content, reviews, and player conduct, and to mark community content as spam. We are not obligated to act on every report but will review reports in accordance with our internal policies. Repeated false reports may themselves result in account action.

10. Pros, lessons & bookings

Pros listed on the Service are independent third parties, not employees, agents, or partners of HonestTech. We do not verify credentials, certifications, or background checks unless explicitly stated. The lesson or coaching relationship itself is solely between the player and the Pro: we do not supervise, direct, or control a Pro's services and assume no responsibility for the conduct, qualifications, or outcomes of any lesson. For TFL-managed bookings we act only as a limited payment facilitator through Stripe (see Section 5.8); for direct-mode listings we process no payment at all. You agree to release us from any dispute arising from interactions with Pros, players, or other users (see Section 14).

11. Physical activity disclaimer

Tennis is a physical activity that carries inherent risk of injury. You participate at your own risk. Consult a physician before beginning any new exercise program. We are not responsible for any injury, illness, or damage arising from your participation in tennis or any activity arranged via the Service.

12. Intellectual property

The Service, including its software, design, logos, and content (excluding User Content), is owned by HonestTech or its licensors and is protected by US and international IP laws. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for its intended personal or business purpose. All rights not expressly granted are reserved.

13. DMCA — copyright complaints

If you believe content on the Service infringes your copyright, send a notice with the elements required under 17 U.S.C. § 512(c)(3) to our designated DMCA agent at [email protected]. We will respond in accordance with the DMCA. Repeat infringers will have their accounts terminated.

14. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY USER CONTENT IS ACCURATE.

15. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • (a) IN NO EVENT WILL HONESTTECH BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL.
  • (b) OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (i) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (ii) ONE HUNDRED DOLLARS ($100).
  • (c) THESE LIMITATIONS APPLY EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE.

Some jurisdictions do not allow these limitations; in those jurisdictions, our liability is limited to the maximum extent permitted by law.

16. Indemnification

You will defend, indemnify, and hold harmless HonestTech, its officers, employees, and agents from any claim, demand, loss, or expense (including reasonable attorneys' fees) arising out of (a) your User Content, (b) your use of the Service, (c) your violation of these Terms, or (d) your violation of any third-party right.

17. Termination

We may suspend or terminate your access at any time, with or without notice, including for violation of these Terms. You may stop using the Service at any time. Sections that by their nature should survive termination will survive, including 7.1 (license), 12, 14, 15, 16, 18, and 19.

18. Dispute resolution — binding arbitration & class action waiver

Please read carefully. This section affects your legal rights.

(a) Informal resolution. Before filing a claim, you agree to try to resolve the dispute by contacting us at [email protected]. We will try to resolve it within 60 days.

(b) Binding arbitration. Any dispute not resolved informally will be resolved by binding individual arbitration administered by JAMS under its consumer rules. The arbitrator, not any court, has exclusive authority to resolve disputes about the formation, scope, or enforceability of this arbitration agreement.

(c) Class action waiver. YOU AND HONESTTECH AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

(d) Opt-out. You may opt out of this arbitration agreement by sending written notice to [email protected] within 30 days of accepting these Terms.

(e) Exceptions. Either party may bring an individual action in small-claims court, and either party may seek injunctive relief in court for IP infringement.

19. Governing law & venue

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. Subject to Section 18, any action must be brought exclusively in the state or federal courts located in Kent County, Delaware.

20. Changes to these Terms

We may update these Terms at any time. If we make material changes, we will notify you (by email or in-app notice) at least 14 days before they take effect and update the "Last updated" date. Continued use after the effective date constitutes acceptance.

21. Miscellaneous

  • Entire agreement. These Terms and our Privacy Policy are the entire agreement between you and us regarding the Service.
  • Severability. If any provision is unenforceable, the rest remains in effect.
  • No waiver. Our failure to enforce any right is not a waiver.
  • Assignment. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
  • App stores.If you obtained our app via the Apple App Store or Google Play, the store's additional terms apply between you and the store operator; the store operator is a third-party beneficiary of these Terms but has no obligation to provide support for the Service.
